A Partner at Pleiss Sitar McGrath Gates & Ajello, Mr. McGrath commenced practicing law in 1985 with Madory, Booth, Zell, & Pleiss, APC. wherein he later became a partner. His practice is concentrated in the area of elder abuse involving residential care facilities, nursing facilities, and acute care hospitals; as well as medical and psychiatric malpractice; governmental entity defense; wrongful termination and personal injury litigation. In addition to defending physicians, chiropractors, dentists, nurses and hospitals in malpractice actions, he represents insurance brokers, and works with matters involving real estate transactions, construction defects, land subsidence and firearms.

Mr. McGrath has litigated numerous cases in the counties of Alameda, Fresno, Los Angeles, Orange, Riverside, San Bernardino, and San Diego, in both state and federal court. He is an experienced trial attorney and has been involved in numerous binding and non-binding arbitrations as well as argued cases before the Court of Appeal. He was also instrumental in creating policy involving release of confidential records in the Orange County Probate Court.

Mr. McGrath is a proud member of the American Board of Trial Advocates (ABOTA); American Bar Association; State Bar of California and the Orange County Bar Association. He has also been a guest college lecturer in matters pertaining to civil litigation.

Mr. McGrath is rated “AV Preeminent” by Martindale-Hubbell and certified through the State Bar of California as well as the United States District Courts, Central District of California and Southern District of California.

Mr. McGrath was born in Long Beach, California and is a long term resident of Dana Point. He earned his B.A. (Social Ecology) from the University of California, Irvine and received his J.D., cum laude from California Western School of Law, San Diego.

Mr. McGrath is most proud of his 27+year marriage to his wife, Margaret, and his three wonderful children, Rachel, Annamarie and Joseph. In his spare time enjoys fly fishing, paddling, snow skiing and surfing.
